1. INTRODUCTION AND ACCEPTANCE

These Terms of Service ("Terms") constitute a legally binding agreement between you and WABICare ("we," "our," or "us") governing your access to and use of the WABICare platform, including our website, mobile applications, and services (collectively, the "Platform").

By accessing or using the Platform, you agree to these Terms. If you do not agree to these Terms, do not access or use the Platform.

2. DEFINITIONS

  • Platform means the WABICare website, mobile applications, and related services.
  • Routine Card means a user-created skincare, haircare, or beauty routine shared on the Platform.
  • Professional User means a licensed skincare professional with verified credentials.
  • General User means any registered user who is not a Professional User.
  • Content includes, but is not limited to, routine cards, reviews, comments, photos, videos, and text.
  • QR Code means Quick Response codes that link to Platform content in retail locations.

3. ACCOUNT REGISTRATION AND TYPES

3.1 General User Accounts

  • You must be at least 18 years old to create an account. You agree to:
    • Provide accurate and complete registration information
    • Maintain the security of your account credentials
    • Accept responsibility for all activities under your account
    • Notify us immediately of any unauthorized access
    • Not share your account credentials with others

3.2 Professional User Accounts

  • Professional Users must:
    • Hold current, valid professional credentials in skincare or related fields
    • Submit verification documents as requested
    • Maintain current licensing status
    • Update credentials promptly upon expiration or changes
    • Accept additional verification processes as needed
    • Maintain professional standards of conduct

4. ROUTINE CARDS AND CONTENT

4.1 Creating and Sharing Content

  • Must have necessary rights to all content you post
  • Must provide accurate information about products and procedures
  • Must disclose any professional affiliations or commercial relationships
  • Must clearly indicate if content is sponsored or contains affiliate links
  • Must not make false or misleading claims
  • Must not provide medical advice unless qualified

4.2 Content License

By posting content, you grant WABICare a worldwide, non-exclusive, royalty-free license to:

  • Use, display, and distribute your content
  • Modify content format for display purposes
  • Use content for promotional purposes
  • Integrate content with retail partner displays and QR codes

5. QR CODE AND RETAIL INTEGRATION

5.1 QR Code Usage

  • QR codes may only link to legitimate Platform content
  • Users must respect retail partner policies and procedures
  • Unauthorized modification of QR codes is prohibited
  • WABICare reserves the right to modify or remove QR code functionality

5.2 Retail Partnerships

  • Content displayed in retail locations must comply with partner guidelines
  • WABICare may modify content display for retail integration
  • Retail partner relationships do not constitute endorsement
  • Users must not misrepresent retail partner relationships

6. PROFESSIONAL STANDARDS AND VERIFICATION

6.1 Professional Verification

  • Verify professional credentials upon registration
  • Conduct periodic verification checks
  • Request updated documentation as needed
  • Maintain confidentiality of verification documents

6.2 Professional Conduct

  • Maintain professional ethics and standards
  • Provide accurate representation of qualifications
  • Not make medical claims beyond scope of practice
  • Clearly disclose professional relationships
  • Update professional status changes promptly

7. PROHIBITED ACTIVITIES

  • Post false, misleading, or dangerous content
  • Impersonate others or misrepresent credentials
  • Harass, abuse, or harm other users
  • Scrape or collect user data
  • Interfere with Platform operation
  • Circumvent security measures
  • Violate applicable laws or regulations
  • Post spam or unauthorized advertising
  • Share explicit or inappropriate content
  • Manipulate ratings or reviews

8. AFFILIATE RELATIONSHIPS

8.1 Disclosure Requirements

  • Clearly disclose affiliate relationships
  • Identify sponsored content
  • Provide accurate commission information
  • Comply with FTC guidelines
  • Update relationship changes promptly

8.2 Commission Structure

  • Commission rates and terms as specified
  • Payment schedules and methods
  • Refund impact on commissions
  • Minimum payout requirements

9. INTELLECTUAL PROPERTY

9.1 WABICare Property

  • Platform design and functionality
  • WABICare trademarks and branding
  • Platform-generated content
  • Proprietary features and technology

9.2 User Rights

  • Original content they create
  • Personal information and data
  • Professional credentials and qualifications

10. TERMINATION

10.1 Platform-Initiated Termination

  • Terms of Service violations
  • False or expired credentials
  • Harmful or dangerous content
  • Platform abuse or misuse
  • Extended inactivity

10.2 User-Initiated Termination

  • Delete their account at any time
  • Remove their content (subject to license terms)
  • Request data deletion (subject to legal requirements)

11. DISCLAIMER OF WARRANTIES & LIABILITIES

11.1 The Platform is provided "as is" and "as available." We do not warrant:

  • Uninterrupted Platform access
  • Error-free operation
  • Content accuracy
  • Third-party products or services
  • Professional advice or recommendations

11.2 Routine Disclaimer and Liability

WABICare provides a platform for sharing skincare, haircare, and beauty routines ("Routines") but:

  • Is not responsible for the outcome or results of any Routine use
  • Does not guarantee the effectiveness, safety, or suitability of any Routine
  • Is not liable for any adverse reactions, allergies, irritations, or other negative effects resulting from following any Routine
  • Recommends users patch test products and consult healthcare professionals before starting new Routines
  • Does not endorse or verify the safety of specific product combinations
  • Is not responsible for individual reactions to products or procedures mentioned in Routines

Users acknowledge and agree that:

  • They use Routines at their own risk
  • Individual results may vary
  • Skin and hair reactions are highly personal
  • They are responsible for verifying product ingredients and potential allergens
  • They should discontinue use and seek medical attention if adverse reactions occur
  • WABICare and its users sharing Routines cannot be held liable for any damages, injuries, or adverse effects resulting from Routine use

12. LIMITATION OF LIABILITY

WABICare's liability is limited to the maximum extent permitted by law. We are not liable for:

  • Indirect or consequential damages
  • Lost profits or revenue
  • Data loss or corruption
  • Third-party actions
  • Force majeure events

13. CHANGES TO TERMS

We may modify these Terms at any time. We will:

  • Notify users of material changes
  • Provide reasonable notice before implementation
  • Consider continued use as acceptance
  • Preserve user rights under previous Terms
